Legal Question in Wills and Trusts in California
my attorney will not send me my file that ive been asking for 2 yrs now
from what i understand this is a serious ethical violation and i should contact the state bar complaint system.
My Question....What proof do i need to even have the state bar look at my complaint?

Proof that this person was your attorney, such as a written retainer agreement. Copies of communications that you have given this attorney, such as letters and e-mails, proving that you have asked for your file.
Mr. Roach is wrong. The State Bar will commence an investigation of this kind of conduct on nothing more than a phone call, and maybe requiring you to fill out and send in a complaint form.
I answered your question based on responding to your previous question about filing a complaint. So Mr. McCormick is wrong. Of course the Bar starts out with a complaint, but if disputed by the attorney, the evidence I mentioned above will be necessary.
