Need to have authority to sign husbands name to a check.

my husband is in jail. i need to cash an income tax check,

both our names are on it. I need to know what type of form he needs to fill out to give me permission to sign his name.

And also what do i need to do to get this going. He is in LA CO Jail

If you have a joint account, the bank will often let you deposit a joint check into the joint account. If not, you'll need a power of attorney from him, which must be notarized, to give you authority. Since this requires his notarized signature, it may be easier to have him sign the check--is this possible?
