Legal Question in Wills and Trusts in California

brother died without leaving a will ?disposition?

My brother died in Oregon after living there for 3 weeks. He'd purchased a double wide trailer and was just getting settled. He still has some property, less than $200,000 in CA. How do we determine proper and legal disposal of the remainder of his property?

I am sorry to hear of your loss.

If your brother passed away without a will then his property will need to go through Probate. In CA, if the value is over $100,000 a Probate is required. (I am uncertain about OR but I can check).

YOu have a couple of options. (1) Open a Probate in OR and in CA, (2) Probate only in CA and request the CA court authorize the sale of the OR property (since it is a mobile type of property and not tied to a specific piece of land, this may be possible).

Please feel free to contact me at my office to arrange a free consultation where we can confidentially discuss some details so I can give you a better opinion of the situation.
