My brother and I were left our parents house in there will,both parents are deceased and so is my brother,how do I get the house put in my name I have the original trust deed and i have the will

Hello-

I am sorry for your losses.

Some sort of probate Court action is required to get the house transferred to you. That is, assuming your parents did not have a trust.

Assuming the house is worth more than $100,000 then a full probate would be required.

If less than $100,000 there is an abbreviated probate petition.

My condolences for your loss!

As to your question, it depends upon whether the property is in trust or not. If it is not in trust, which may well be the case, then you will most likely have to go through probate. If it is in trust, then the process is easier and faster.

In either event, I recommend you contact an attorney in the county where your parents lived. That attorney will best know the court process and will be able to provide the most effective assistance.
