Legal Question in Wills and Trusts in California

My brother passed away recently in CA. Several checks have been received in his name and "to the estate of" for unused auto insurance, rental deposit, etc. All of his accounts have been closed out- how can these checks be cashed? This is my first time dealing with this and I have no idea what to do.

After forty days has passed since his demise you can try what is called an affidavit of right (a form usually available from county bar websites). Follow the instructions that (should) accompany the form and submit it with a certified copy of his death certificate to the bank.
