Legal Question in Wills and Trusts in California

name change and wills

...Just curious about the ramifications of changing my last name (for personal reasons not having to do with marriage)and the effect it may have regarding my father's will. My father just passed and for the next two years our family will be involved in liquidating his company and other issues regarding inheretance. Will changing my last name have any effect on receiving my inheretance? Thanks for your time!!!

Re: name change and wills

as long as you were correctly identified in the will as of the date of your father's death, any subsequent name change should not affect your rights, if any. by now a probate should have been opened and you should be receiving notices and documents related to probate of his estate. if not, you should retain an attorney to determine whether or not you should file a petition for probate and advise you regarding this matter.
