Legal Question in Wills and Trusts in California

No estate

Father died in 2003. There have been a few issues arise lately and he had no estate. As the sole heir, I simply handled his immediate business, a few credit cards and turned in 2 vehicles he had leased. Now it turns out that he had a rebate on one of the vehicles. It is drawn out to his estate. There was none. No power of attorney was made either. What are the possible solutions?

Re: No estate

You should able to submit a declaration under Probate Code Section 13101 to the issuer of the rebate check issued in your name. The code section has all of the information that you need. I have done this before, so feel free to contact me if you have any questions.
