Legal Question in Wills and Trusts in California

My father passed away two and a half years ago. I was told by his wife that there is no will. However, some of my fathers friends say that there were legal documents kept in his personal safe. What can I do or is there any course of action I should take? His wife is uncooperative.

You need to get a lawyer and go to court if she won't cooperate.

Mr. Reich is right. More specifically, you need to open a probate and get an order that she produce his papers.

I would look at how much property he had, and how title to the property was held before running out the door and filing an expensive probate action. If he had no property, or it was held in joint tenancy, probate may just be a gigantic waste of time and expense.

If you want to waste time and money, buy a boat, they are a lot more fun.
