Legal Question in Wills and Trusts in California

Father's Will

It has been 12 yrs since dad died and I just found out that there is a Will. My step-sister who was left as Executor has it and says she will not show the Will until my mother dies Can she get into trouble for this, also how can we find out if she even recorded the Will? Would like to know exactly what my father's last wishes were.

Re: Father's Will

Look at our past answers to this very comment question. The short answer is that she is supposed t file the Will shortly after his death, the Will is a matter of public record [try going to the local court's web site or down to the court to look up any filings with your father's name on it, check who the tax bills are going to and any liens against the property]. If you still can not get the Will, have the whole family go to your sister and ask why she will not turn it over, does she know she has violated court rules, when it does have to be probated the court will not allow her to be the administrator and may fine her, she is legally liable for any damages she causes, etc.

Re: Father's Will

You will have to file for probate of the estate and request to be appointed administrator so you can get the power of the court to obtain the records.
