Legal Question in Wills and Trusts in California

A friend’s father passed about 6 months ago and his father had told him he was in the will. Recently, his sister told him he wasn’t, will not return calls, etc.... how can he access the will? He resides in Calif as did his father. I looked online at the county court website and nothing has been filed in probate.

If his sister had or has a will, she was supposed to lodge it with the court within 30 days of finding out about the death. Of course, if someone else had/has it they should have done so as well. Your friend could file for probate himself, and even be appointed executor or administrator. If there is no surviving spouse and no will your friend stands to inherit his share (which depends on the number of children of the decedent).
