Legal Question in Wills and Trusts in California

heir's questions about inheritance

Father passed away 1 1/2 yrs ago, the year before he took ill he signed the house to my little brother (6 siblings in all) because he was worried about losing house to medical expenses down the road. My mother is dying and there is no will. I do not know if this was a trust or just deeded to my brother..He has said in esscence that Dad wanted the house to stay in family and as my brother and wife live in the attached apartment to the house and have so for many years, and they were the primary caregivers for my dad in his final year, they feel the house remains with them. I do not think this is fair to I and my other 4 brothers. Two of my brothers have ''I don't really care attitude'' and I now feel I am being insensitive to be bringing up these questions. My brother is willing to remove himself from a $32,000 inheritance that my mother received in lieu of the house. Where do we stand on this? My brother handles all the financial dealings for mom right now, he is POA.

Re: heir's questions about inheritance

this depends upon current title to the real property and the language of the wills, durable powers of attorneys and any trust of your parents. these documents all need to be reviewed to determine the current situation.
