Depends. A surviving spouse has certain rights to community property and an omitted spouse may have rights to even separate property. If property is titled a certain way it may not even be part of your Estate. You need to talk to an estate planning attorney. You refer to "my money" but I can't tell from this post whether this is community property from earnings during a marriage, property that you owned prior to the marriage, or assets that would have a mixed community and separate property character.
