I live in Minnesota and have been named as possible executor of an

estate in California. Do I have to physically appear in California, or can I do all transactions from Minnesota?

Your are not required to be present in California. Although you physical presence is not legally required you must keep the property in California (such as bank accounts) until probate is concluded. Our firm has many clients out of state, many of whom never come to California but are executors and trustees of California trusts. We would be willing to consult with you regarding possible representation tomorrow between 9 and 5 pacific time. You may call us toll free at 866-988-3956.

I just handled two probate cases in which my clients were situated outside of California. So, physically appearing in California is not necessary. Please contact me for a free consultation.

I am sorry about your loss. I practice law in Minnesota (Eagan) and California (City of Orange). It may be beneficial to have an attorney that has a presence in both states. Please feel free to give me a call to discuss your situation at 612-701-7767. I look forward to hearing from you.

Correct - you do not need to be in California. As an Irvine estate planning attorney, you need to have legal counsel local to your probate proceeding. I see the attorney above me practices in both California and Minnesota, that would be the best choice. Good luck.
