For how long after an executor's (or appointed administrator's )failure to perform his/her legal duties can he still be sued?.

If he has been discharged by the court i don't think there is any recourse. The court usually sets what is known as an Order to Show Cause hearing if an estate has been open too long, but once its closed, its closed.
