Legal Question in Wills and Trusts in California

Mother's death without estate, will or trust

My mother just died this weekend and did not have a will or trust made out. The only personal property on any value is a vehicle (that has a small balance) and jewelry that was put into hock recently. We are trying to find out what we will need to do legally to have one brother take possission of the vehical and be able to claim the jewelry without making us financially responsible for her debt.

You are not personally liable for her bills, but the estate (her assets) are. That means if you want to use the car, you must make the payments or sell the car and payoff the loan. Same with the jewelry. If you do nothing, the bank can reposess the car and whoever has the jewelry can eventually sell it.
