Legal Question in Wills and Trusts in California

My neighbor is selling her house, our back yards have a fence that needs to be replaced, but she states in her selling agreement that she cannot pay for half replacement. Half of the fence has already fallen onto her side of the property and we have a swimming pool which makes it a safety hazard.

What is my recourse in this situation. Can I have a promissory note stating she will pay her half at close of escrow?

Yes if she will sign it the pool hazard is your responsibility not hers so you need to secure it ASAP.
