Legal Question in Wills and Trusts in California

How do i obtain a copy of my dads will? His widow says my sister and I are in it and he gave us each 1/4 of his home. She is not forthcoming with a copy of this. How do we get this and have it put in everyones name. Is there any probate tax? I do not know who his attorney was. Is this a public record and how would I find it?

If you do not know who his attorney is and you can not locate a copy, then what is going to happen is his estate is going to pass intestate. This means that his spouse is going to inheret everything.

The only other option is to find the attorney who wrote it, this person should have retained a copy.
