Just an interesting hypothetical scenario...

Your friend dies in a surfing accident. Before he died, he had mentioned to you on more than one occasion, ''dude, if anything happens to me, you can have my surfboard''. Do you have any legal right to claim the surfboard?

is there provisions in state or federal laws for oral wills? how does that affect someone that: a) doesn't have a written will and b) someone that has a written will?

Re: oral wills

California does not recognize oral wills. If a California resident is not happy with the results of the intestacy rules, they should have an estate plan which replaces the intestacy rules.
