Legal Question in Wills and Trusts in California

Penaly for not following the final ruling on a Will ordered by a Judge?

My Wife passed away and had a Will made out to the effect taht her Son would receive the Original Furniture that was in our home. He also received a 457 Retirement plan and a few other Insurance policies. He and his Wife harrassed me to the point of a second heart attack and the lady that was appointed as the Executor was involved also. They wanted to make sure that they received all the Original Furniture that was in the home prior to our marriage. I gave the attorney an itemised account of all the furniture and they agreed to the final outcome. They were suppose to pick it up and to this date that have to contact me. I have had it in storage because I moved out of the home. What can I do about the storage fees and the furniture since they fail to contact me or the Executor failed to contact me too?

you should send them a notice by certified mail return receipt requested to pick up the furniture and pay the storage charges to date. your notice should also state that if they do not pick up the furniture and pay the storage charges by a specific date, you will sell the furniture and apply the proceeds to the storage bill.

they may have a right to any remaining balance, so you should deposit the balance in an interest bearing account and hold it for them for some reasonable period of time.
