Legal Question in Wills and Trusts in California

Petition For Final Distribution

I am ready to close my cousin's probate for a very small estate in California. I am the Petitioner in Pro Per. In his will he left some personal items to various people. I have already given those items to them. I am supposed to attach an exhibit to the petition that states the proposed distribution of those items. Since they have already been distributed, do I still need to attach it? Or should I attach it and just say that they have already been distributed? I realize now that I should have waited until the final order was received but it's been almost 5 years since I opened the probate. Thx!

Re: Petition For Final Distribution

Legally, you should attach it and say they have already been distributed. You need to make sure you specify who they were distributed to. You are correct though, you should have waited until the final order has been received. Realize, there is a chance you could be liable for the value of the items if a problem comes up.
