Legal Question in Wills and Trusts in California

power of attorney or conservitorship?

I need to know how to secure authority over my long time friend who is now elderly, in a wheel chair and has to pay for nurses and aides out of his pocket. He would like me to oversee his finances, but we don't know which documents we need. Also, if he were to expire, handling his bills and last obligations, what form do I need to have in my possession?

Re: power of attorney or conservitorship?

If your friend is still competent, he or she should retain an attorney to do an estate plan that would include powers of attorney. If you friend is no longer competent, then you will probably need to obtain a conservatorship, which vests legal authority for your friend's affairs in you or another person.
