When does a power of attorney take effect?

When does a power of attorney take effect? And does it have to be recorded. Does all children have to be notified of this matter prior to it taking place?

Re: When does a power of attorney take effect?

Under Oregon law powers of attorney take effect when they are signed.

They do not have to be recorded unless they are being used to transfer real property. If used to transfer real property they are recorded when the deed is recorded.

No one other than those who are dealing with the agent (i.e, the bank, a title company) needs to be notified of the existence of a power of attorney.
