Legal Question in Wills and Trusts in California

Probate for my father's estate opened June 2007 and has yet to be resolved...

I am the sole heir of the estate and have not recieved a dime of the 400k plus estate. Help! I don't

know what to do, but I do know that if I wait any longer I may loose it!

You should consult with a local attorney to look at the court files and see what issues have prevented the executor or the attorney from closing the estate. Ordinary fees are set by statute so unless there are extra-ordinary services required (and it doesn't sound like there are), then it would be in the attorney's best interest to close the Estate as soon as possible so the attorney can get paid. You need to talk to the attorney for the estate; call daily if need be until you get answers. Is probate in Fairfield? If the attorney is not moving the case along, find another you can work with. You don't say why it is delayed. You as sole heir are entitled to copies of the filings with Court and any accountings so you should have an idea what is going on. Sitting passively by while others delay will not get you where you want to be.
