Legal Question in Wills and Trusts in California

Rights of a beneficary of a will

My wife is the beneficiary of a trust. The deceased past away October 2004. The Estate is large. We feel we are getting the run around. We are in a financial hardship. We asked for a partial distribution Novenber 2005 and were told no by investor, who had called my wife to let her know she was receiving a large amount of money. The investor would always tell my wife not to tell anyone she would be receiving the money. We were told by the investor that we would receive partial payment on 12-31-2005.Then on 1-31-2006 and 2-28-2006. A lawyer also called her in January to let her know she would be receiving a large amount of money. He then

asked her if she would like to receive a partial distribution? My wife said yes. He called back the next day

and said that the executor of the trust said no. We then asked for a copy of the trust, which was to be mailed certified mail on 2-21-2006. We keep calling but we are not getting returned calls.

You are most certainly getting a "run around".

BIG CONCERN...Who is this "investor" and what say would they have for anything? If your wife is a beneficiary, she should be able to get a copy of the trust from the executor.

We would be happy to assist you in getting the documents you need and clearing up this matter for you.

Re: Rights of a beneficary of a will

It sounds like you are getting the runaround.

You need to get a copy of the trust and see how and when the estate is to be distributed. As a beneficiary you are entitled to it.

Let me know if you want to discuss the matter.
