Legal Question in Wills and Trusts in California

My son has a disability and has money in a blocked account. He will turn 18 in 2 weeks. What are the procedures to releasing the funds to my son and myself .

Without knowing how much money is involved it is hard to know if there may be a few other issues you need to consider.

If your son is receiving Medi-Cal or other means tested benefits, then receiving this money could cause problems. If he is SSI eligible, then receiving this money could disqualify him from those benefits as well.

If there are no benefits issues, then either the order itself blocking the account has language sufficient to release the funds or you will need to submit an application to the Court for an Order releasing the funds. It's form MC-357.
