I need to transfer my home (real estate) into our living trust in california. what do I need to do? Forms?

You will need to file a Preliminary Change of Ownership Report, perhaps a tax clearance certification depending on where you are, and a new Deed transferring from what it was to the trust. I can help.

And, be careful, you don't want a Prop 13 reassessment. You should consult with a trusts attorney in your area for help.

The attorney who prepared the trust should have done that for you. If they can't or won't take care of it, I suggest you use a title company rather than a lawyer. The process is simple and they are much cheaper (and actually probably more capable, since other than estate planning attorneys, they are the ones who do this kind of thing, not lawyers). All you need is a deed from yourselves to the trustees. The title company will know exactly how to word the deed and what other papers have to be submitted to the county recorder in your county.
