My good friend passed away and we dont know if he had a will. His father is in charge of everything and we cant get direct answers from him, though he said the estate was going into probate. This man died 12-21-08 and when I call the county to get the case number, there is none (over a month later). How can we find out if there is a will? Isnt a will a public record and cant we go to courthouse to view it?

Prob C �8200 provides that, unless a petition for probate of the will is earlier filed, the custodian of a will must, within 30 days after learning of the testator's death, deliver it to the clerk of the superior court of the county having jurisdiction of the estate.
