Legal Question in Wills and Trusts in California

Hello -

Over the last several years, my brother was made executor of my parents' estate as they were both quite ill. They have now both passed with the last dieing in August of 2010. The kids in the family have been given some rough idea of the division of the assets, but nothing else. We have no idea how much money there is and the specifics. There has been no official documents like a will. We ask our brother, but he says the lawyers are still settling the estate.

Is it normal to take this long? Should there have been a reading of an official will? We are in California. Does that make a difference?

A good yardstick is six months. Do you suspect there being any wrongdoing? You should contact our firm to call the trustee's attorney on your behalf. Your brother's attorney represents him as trustee and does not represent you as a beneficiary. This posting is not legal advice and should not be construed as such. We would be happy to speak with you. Our number is 916-235-8700x123. Jim.

you should retain a qualified attorney to represent you in attempting to obtain information from your brother, and if necessary file a petition to compel an accounting with the superior court.
