Legal Question in Workers Comp in California

I have been asked to resign from my position, but my doctor still has me on restrictions. I also have a workman's comp appointment tomorrow. Would the resignation still be valid if I still have an open workman's comp claim?

Why would you resign just because they asked you to do so?? That's probably just about the worse thing you could do at this point. If they want you to leave, then you shouldn't resign, you should hang tight and they need to lay you off if that's what they want to do, but I wouldn't resign.

Best regards,

JIK

If you are unable to return to work, then you need to settle your case at a higher value. Don't make it easy on your employer and insurance company and resign at this point. Your employer is obligated to provide a reasonable accommodation for your restriction. Don't listen to them and resign voluntarily!!! Feel free to call us at 213.388.7070 for a free consultation.
