Legal Question in Workers Comp in California

Assault

I'm a Merchant Mariner and I was Assaulted last September while I was working on a Ship in Key West. I was kicked on my chest and was out of work for two months, due to chest pain. I was never compensated by my employer and I contact three lawyers and they said I don�t have a case to sue, because I don�t live in the County where the incident took place and Merchant Marine laws are different. Can anyone give me some advise?

Since you were a merchant marine, I am not sure who your employer was. This case normally falls under "Admiralty Law". If your case does fall under "Admiralty Law, an attorney in another State should be able to file a Law Suit for you. The problem is finding an Attorney in your area that practices Admiralty Law.

I suggest you call the Local County Bar Association and ask for a referral to an Attorney who practices Admiralty Law. You may try the State Bar of California for a referral as well. Good Luck.
