Legal Question in Workers Comp in California

Benefits

I drew my disability first and workers comp did not start close to a year.It took them that long to kick in. Disability was paid back. I just now had surgery on my left hand and Dr, wants to wait and see how this heals before he does the right thumb wrist area. Which I am rt. handed. Workers comp checks stop in April. Can I re open my claim with disability being that I have not had the surgery on the left hand and still disabled to work. I also was awarded social security due to my hands. Or does workers comp still have to pay.

Thanks

Re: Benefits

The insurance carrier will stop paying TTD due to your receipt of Social Security, so the issue is moot. If you have not settled your claim, there is no need to re-open it to add additional body parts if your claim is not more than five years old.

New cases decided last month vastly change the value of all WC cases. This matter is complex and you should not try to do it yourself so you should get an attorney to discuss your options. If you are located in Southern California, you can email me your contact info, so we can discuss your particular situation. There is no charge for consultation.
