Legal Question in Workers Comp in California

business insurance liability

My husband & I own a small record & CD store in California. We have no employees. For the last month, a young man has been spending a LOT of time hanging out in our record store. He's a nice kid (late 20's), but lately, he's been interjecting himself to help other customers find selections. To these other customers, it certainly appears that he works here. We have taken him aside and told him not to do this, but it falls on deaf ears. We are one of the few truley 'old-fashioned' record stores left where music buffs come to 'hang out', and I would hate to ban this kid from the store.We simply cannot afford to hire anyone(so that's not an option). If our insurance agent, or someone from worker's Comp were to walk in while this kid is 'helping' someone, will there be an issue? If there could be any trouble at all and if I can show this kid something on paper, maybe he'll stop.

If I were you, I would insist that the guy wear a T-shirt or button that reads, "I don't work here."
