Legal Question in Workers Comp in California

carnal tunnel

I had surgery on my left hand for carnal tunnel it took chubb insurance over a year to approve my surgery I was out of work for 5 months. I have recover and back at work they want to settle for $5,000 I believe I should get more. Please advise

Basically, you probably have an uncontested QME reports from the employer's doctor giving you a very low whole person impairment.

Perhaps you should get more money, but without an attorney it may be difficult to do so.

With thats said, you have to object to the QME report, then request an AME. If the doctors that you chose are rejected by the defense, then off to a panel QME you go. Finally, the panel QME will arrive at a finding. If you do not like the finding, you must object and reserve your right to cross-x the doctor, hoping that he will change his opinion.
