Legal Question in Workers Comp in California

Changing Zip codes or States while under a W/C claim?

If I filed a W/C claim in California, and as a result, may need surgery and months off work to heal...it might result in me having to move out of my apartment, and someone needing to take care of me. What happens to my claim if I change zip codes or even states? Is my treatment still covered?

We have a lot of clients in your situation who are currently are living out of state. I recommend that you get your initial treatment done here in California and in the meantime schedule a state QME or AME examination so you can be evaluated and your disabilities can be rated as soon as possible. You will still be able to receive treatment. However, you may have to find another treating physician. With regardss to moving out of California, an out of state doctor still has to comply with the California Labor Code in order to draft admissible medical reports. Therefore, it is very difficult to find an out of state doctor who would be willing to take on an injured worker from California.
