Legal Question in Workers Comp in California

Compensation Benefits

I am a delivery driver who got into an accident while on the job. The person who rear ended me was at fault. His car insurance agent offered me a settlement because of the pain in my lower back. I have filed a claim and seen a doctor through workers comp which then referred me to a therapist. Am I entitled to receive a settlement through the Car Insurance company as well as Workers Compensation?

Absolutely, you can have a workers comp case and personal injury case simultaneously.

Please know that the workers comp ins. co. can file a claim for subrogation (reimbursement) from any settlement amount that you receive that accounts for medical bills paid for by them... and temporary/permanent disability benefits paid for by them as a result of this accident.
