Legal Question in Workers Comp in California

employer not having worker's comp. insurance

I'm trying to find out how i can find out if my employer has worker's comp. insruance. I have a co-worker who got injured on the job and the way our employer is handling things is leading me to believe they are not insured. It took my employer alomst 2 months to get my co-worker a Dr. for him to get treatment at and then he was told that he needed to get petty cash to pay for the Dr. visit. my co-worker was in so much pain that he had to get some treatment in mexico because our employer was taking so long to address his injury. He went to mexico because were located in San Diego and it's cheaper in mexico then in the U.S. now he is going to physcial thearpy for the injury and is having to pay cash for that too. My co-worker has payed out $500 or more of his money and my employer said they will pay him back but to this date have not. My co-worker has also had to take off some days from work due to the injury and was told he would get paid for them but my employer did not when it came to pay day and now my employer is telling my co-worker that they are not going to pay him for thoes days off now. All these things got me wondering if my employer is even insured.

Re: employer not having worker's comp. insurance

By law, an injured worker's employer must provide the injured worker with workers' comp insurance information upon his/her request. If they fail to do so, the injured worker can self procure his/her own medical treatment. However, the injured worker must first find a doctor that will be willing treat him/her on a lien basis so that he/she doesn't have to pay from their own pocket. This is why injured workers' hire attorneys. Without counsel, it is difficult for injured worker2 to navigate themselves through the workers' comp system.

If your co-worker would like a free consultation, he can call 1.877.505.INJURY. We speak Spanish.

Re: employer not having worker's comp. insurance

you need only request a statement from the WCIRB, which I believe costs $8 to see who is your employer's insurance carrier for comp. You can also look for PSI data with the secretary of state.

We will refer him to a doctor that will see him on lien basis. Also we can order WCIRB insurance information and check if the employer has any insurance. Please call us or have your friend call us at 213.388.7070 for a free consultation.
