Legal Question in Workers Comp in California

Should I file a claim or is it to late?

My husband worked at small resort as maintenance man for

13yrs. Job required heavy lifting, digging etc and as a result his back

had progressivly gotten worse. He was laid off in dec of 05 but cannot

seek employment because of severe back pain. He did not file before

because he don't think employer had wc insurance. Can he file a claim even if

they did not have wc insurance or is it to late?

It is not late to file a claim for Worker's Compensation benefits. There are different ways to find out insurance information about an employer. Even if the employer is uninsured, UEF (Uninsured Employers Fund) can be joined which acts as an insurance company. Please call us at 213.388.7070 for a free consultation.

It is not too late! I recommend filing right away. Do not be concerned with whether or not the employer has insurance. That is what UEF is for.
