Legal Question in Workers Comp in California

Final Settlement

I broke my wrist at work and had to see a wrist specialist, who eventually performed surgery on it. He told me that I would never have full use of it again and that most likely, I would eventually get arthritis. I wear a brace each night because of the pain. Initially the Ins co. offered me 6k + 2k lifetime medical. I told them that the their offer would not have covered the medical I had already undergone. The Ins Co then told me that they would try to get me something between 15 & 32K. Today she came back with an offer of 13k. I still don't think that this sum will cover my future medical costs. Do I need to retain an attorney?

The worker's compensation system is very adversial. The insurance companies will get away with anything they can. They will pay you the minimum on your claim unless you obtain representation to protect your interests. The worker's compensation insurance companies have attorneys, why don't you? Attorney fees are limited by law to 9% to 12% of the final settlement or award. I would need to analyize your medical records to determine what would be an adequate award.You would be well served by obtaining representation.
