Legal Question in Workers Comp in California

My husband works as a server and also sets up weddings for the same restaurant. He thought he pulled a muscle while at work but it turned out to be a hernia and the doctor wants him to stay home for 2 weeks. Is his company (who has a wc program) required to pay him for lost wages as well as his medical bills under CA law?

If a physician finds the hernia is work related, then your husband should file a claim and request Total Temporary Disability for the time he is unable to work.

He needs to be on temporary disability benefits as long as doctor recommends. Feel free to call us at 213.388.7070 for a free consultation.
