Legal Question in Workers Comp in California

Quit job while on Workers' Comp

I was injured and on light duty when I was promoted to a new position. I worked the position for several months and then was told that I was being replaced by a supervisor. There was no offer of light duty again. I went home and when I asked the insurance company why I haven't been compensated I was told that I quit my job. I did not quit but that's what my company has told insurance company. How do I correct this?

I strongly recommend that you obtain representation and file a 132(a) against the employer along with an Application for Adjudication of Claim.

It sounds like you have been wrongfully terminated as a result of a work-related injury. Therefore, hire an attorney ASAP and file a comp claim along with a 132(a).
