Legal Question in Workers Comp in California

I did get a request from workers comp(SRS) for disclosure of all medical information due to a traumatic incident at work.I did receive treatment(3x) from a psych,no further treatment was neccesary.Am I obliged to release all medical records or just the ones which RELATE to the case?

Thank you very much for your professional reply.

You are required to inform the comp. carrier of all health care providers you have seen for the injuries or anything medical related to them or your disability [if you hurt you arm and have a reduction in weight lifting ability, a prior back injury that also limits your lifting capacity would be relevant]. They will then obtain the records. If you give them a release of medical records you can ask for a free copy of everything they get. The providers, even after you instruct them, often will just make your enitre medical file available for copying.

Why do you make the claim adjusters' job so easy? you are not obligated to provide them with all your records and let tyhem do their own investigation and because you are not an attorney you don't know which one is relevant. You will be obligated to provide them accurarte information at a deposition. Feel free to call us at 213.388.7070 for a free consultation.
