Legal Question in Workers Comp in California

Should I seek legal counsel

I injured my back at work several months ago. Initally the company accused me of faking it and implied that I was doing it out of spite and then asked for a re-evaulation.

Since that time the company has repeatedly supplied the Worker's Compensation Representitive with inaccruate and incomplete information.

After undergoing several months of physical therapy and one epideral injection my doctor asked me for detailed job description. The company responded by claiming that, because of the doctor's limitations, in their opinion I am no longer able to perform my regular job functions.

Now I've received a letter from a Managed Case Specialist representing the Insurance company.

What's my next step.

If you have only been seen by the employer's/insurance co.'s doctors, you should be referred to a doctor that takes the applicants' cases. The worker's compensation system is very adversial. The insurance companies will get away with anything they can. They will pay you the minimum on your claim unless you obtain representation to protect your interests. The worker's compensation insurance companies have attorneys, why don't you? Attorney fees are limited by law to 9% to 12% of the final settlement or award. Call me directly at (619) 222-3504.
