Legal Question in Workers Comp in California

waiting around

I injured myself @ wrk 2/08 on 10/08 i was placed on modified duty. the job claim the work they have clerical pay 10.00, as a nurse I made 22.00, is this right they can take my pay like this. and they cannot give me the days off i need do they have the right to refuse my normal pay and deny me days off.

The employer plays many games in order to reduce, or eliminate an injured worker's claim. This is exactly why injured workers retain counsel.

It is very difficult to prosecute a workers' compensation claim on your own. With that said, you should be entitled to two thirds of your rate of pay. Your pay check stub should be your evidence as to your true rate of pay. This should be submitted to your employer.
