Workers Comp AME Report taking way to long

I was injuried at work in May of 2002, filed my claim had double hernia surgery in 03, pelvic bone fragment removal in 04, and still didnt solve the pain. In June of 04 the IC had me see a AME. Normal procedure and in September his report came out and made me P&Sd. He did this without all the medical reports so IMy attorney filed to have him cross ex. OK here is now my question, in March of 05 had an other AME which he found that I needed more testing so he ordered them. After all the test were in he found that I wasnt P&S, but TTD. He found out that I have 4 reptured disc, L1-L2 8.3mm which extends upward twards the spinal cord,and in his opinion could cause CAUDIA EQUINA, which I understand could cause parliase. The other disc are L4-L5 5.7mm, L5-S1 6.7mm. The AME , after having me see a second opinion neuroligst, concured with him and my Spinal Surgeron that surgery should be done, fusion at the lower levels and either a disc replacement or a discetamey at the upper level. OK here is my main question, . THE REPORT HAS BEEN SITTING ON HIS DESK FOR 3 MONTHS. The longer He waits to write it the worse I get. All's I hear is that he is busy. Could this AME doctor be held neglagent for not getting this report out on a timly matter.

If you know what is in the second AME report, how can you complain that it was not served???

Call your attorney. That is my recommendation.
