Legal Question in Credit and Debt Law in Canada

Judgement against me

I have a judgement against me from Capital One in the states. I am a Canadian Citizen now living back home, I was wondering if there is any legal action that can be taken against me, and also, am I able to cross the US border to visit family, or will I be denied entry because of the judgement? I have not received any paperwork here in Canada. Any help would be appreciated

Re: Judgement against me

As noted on the LawGuru website, question directed to this firm will be answered with reference to British Columbia Law.

It is immaterial whether or not the judgment was American or Canadian; matters such as this are governed by the laws in force in the particular State and Province or Territory.

The creditor can most certainly take action against you; if the State in which the judgment was obtained has signed the Reciprocal Enforcement provisions of the Court Order Enforcement Act of British Columbia, there is a simplified method of collecting; otherwise they use the "normal" method.

As to whether or not you may cross the border, we are not permitted to answer this question as it involves American Federal law and most Canadian lawyers are not licneced to practice American (Federal or State) law. For an answer to this question we suggest you hire an American immmgration lawyer.
