In British Columbia you would in all probability have a claim but it is impossible to say how much your award would be as many more facts have to be ascertained; some, but not all, are:

1.The nature and extent of the injury

2. You know your toe was broken, but what kind of fracture?

3. How long to recover?

4. Is there any permanent injury?

5. Does the injury impact you employment in any way?

6. Were you performing any duties related to your work in any way? If so, it may (or may not) be that you are required to make a worker's compensation claim instead of suing.

These are just a few of the facts that must be found out. Usually a physician's report is necessary; your own thoughts are not usually sufficient.

In some provinces you can not sue for this sort of injury; in some the amount of money you can expect to recover must be over a certian threshold. As you have not given your postal code, although LawGuru asks for it, we can not determine what Province you live in. Therefore this answer may valid for B.C. only.
