Legal Question in Wills and Trusts in Canada

My father put me as joint co-owner of his bank account. He has no will. If he should die, is that money legally mine or do I have to share it with any siblings.

As noted on the LawGuru website questions directed to this lawfirm must be answered with reference to British Columbia law. The law varies from Province to Province and may not be the same in other Provinces or Territories.

If you are a true co-owner then the money is yours now regardless of whether or not your father should die, but we question whether or not your father made you a co-owner or just gave you authority to sign cheques, make deposits, and so forth, either by giving you a power of attorney or signing an authorization at the bank. If that is all he did, then the money is his and not yours. You should check withthe bank to see if what you have is a power of attorney, signing authority or if you are a real owner.
