Legal Question in Family Law in China

sperm theft?

I lived in Jamaica Plain for 10 months in 2004. I met a woman through an adult sex/swinger website. we had a fling for about 3 months. I'll spare the gory details for now, but long story short, she got pregnant, kept the information from me until she was nearly 7 months along (we broke up after she knew she was pregnant) and JUST BEFORE (one week) I moved to China she began harassing me saying I was the fATHER.

I asked to get a DNA test before I moved (there was only one instance of unprotected sex with her, and I maintain that she forced that when I was under the influence of alcohol (THUS POSSIBLE SPERM THEFT?) she awakened me over the weekend of Memorial Day 2004 and then would not permit withdrawal, screaming ''I want your child'' over and over.) Needless to say, that was the last time i was with her sexually, but we did have contact through phone until July 6, 2004. She refused the DNA test before I moved to China.

Now, she's suing me for some support, and wants a DNA test done. Her sister flew here to deliver a summons (which I didn't sign) and the court date is March 16. Should I contact the court or wait until I am back stateside (about 2 yrs later) to resolve this?

Re: sperm theft?

I don't think it would be advisable to try to resolve this when you get back. You need to obtain counsel to represent you while you are gone and to obtain a DNA test. If you are the biological father, it would be difficult to avoid financial support obligations based upon the evidence that you alluded to.

Feel free to give me a call or email back with questions.
