Depression and workplace dicrimination

Can employer deny written doctors note that due to depression, fatigue and sleep deprivation that I needed to be given a dayshift to try to alieve some of condition and try to get me back to "normal". In writing my employer denied this request if this was unacceptable i could transfer or resign. However they have given two pregnant women choice schedules which we all have the same job decriptions and duties, because they are tired not to mention I have been there 1 and a half longer than them. I was told pregnancy is a medical condition and depression is not. Can they do that?

Depression may be a disability under the Americans with Disabilities Act, depending on the level of your physical/mental restrictions. State Law may also protect you. You may want to contact an experianced labor attorney to handle your case.
