Each jurisdiction adopts different asset protection laws. In some districts both federal and state exemptions are available. In most no-asset cases, most of the debtor assets will be exempt. You need to be very careful with secured assets. If the equity in the secured asset exceeds the allowable amount under the exemption, you might risk losing the asset to the trustee. Feel free to contact our Denver bankruptcy attorney for a free consultation regarding asset protection.
